1. Acceptance of Terms
Welcome to TR Prompting Academy, a division of TR Public Records, LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at trpublicrecords.com (the "Site"), including all courses, training materials, digital content, and related services (collectively, the "Services").
By accessing our Site, creating an account, enrolling in a course, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Site. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
2. Eligibility
To use our Services, you must:
- Be at least 16 years of age (or the age of majority in your jurisdiction, whichever is greater).
- Have the legal capacity to enter into a binding agreement.
- Provide accurate, complete, and current registration information.
- Not be barred from using the Services under applicable law.
If you are enrolling on behalf of a company or organization ("Corporate Client"), you represent and warrant that you have the authority to bind that entity to these Terms.
3. Account Registration
To enroll in courses, you may be required to create a student account. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms.
4. Course Enrollment and Access
4.1 Enrollment
By enrolling in a course, you are purchasing a personal, non-transferable license to access the course content for the duration specified in the course description. Enrollment is subject to availability and payment of the applicable course fee.
4.2 Access Duration
Unless otherwise stated, course enrollment grants you lifetime access to the course materials as they exist at the time of your enrollment, including any updates made during the active support period. "Lifetime access" means access for as long as the course exists on our platform.
4.3 Course Updates
We regularly update our courses to reflect the latest developments in AI prompt engineering, including updates to Claude and Nano Banana frameworks. While we strive to keep content current, we do not guarantee that all course materials will reflect the very latest features of third-party AI tools at all times.
5. Pricing and Payment
- All prices are listed in United States Dollars (USD) and are inclusive of applicable taxes unless otherwise stated.
- Payment is processed at the time of enrollment through our secure, PCI-DSS compliant payment processors.
- We accept major credit cards, debit cards, and other payment methods as displayed during checkout.
- Promotional pricing, discounts, and coupons are subject to specific terms and may be withdrawn at any time.
- We reserve the right to change course pricing at any time. Price changes will not affect existing enrollments.
6. Intellectual Property
6.1 Our Content
All course content, including but not limited to video lessons, written materials, exercises, code samples, graphics, and assessments, is the intellectual property of TR Public Records, LLC and is protected by copyright, trademark, and other intellectual property laws.
6.2 Restrictions
You may not:
- Copy, reproduce, distribute, or publicly display any course content without our prior written consent.
- Record, download through unauthorized means, or create derivative works from our course materials.
- Share your account credentials or course access with others.
- Use course content for commercial purposes (e.g., reselling, creating competing products) without explicit authorization.
- Remove or alter any copyright notices, watermarks, or proprietary legends from our materials.
6.3 Your Content
Any content you submit through our platform (e.g., project submissions, forum posts, course reviews) remains your intellectual property. However, by submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with our Services.
7. Code of Conduct
When using our Services, you agree to:
- Treat fellow students, instructors, and staff with respect and professionalism.
- Not engage in harassment, discrimination, or abusive behavior in any community forums or interactions.
- Not use our platform or course materials for any illegal, harmful, or unethical activities.
- Not attempt to gain unauthorized access to any part of our systems, accounts, or networks.
- Comply with all applicable laws and regulations while using our Services.
8. Certificates of Completion
Upon successful completion of a course (as defined by the course requirements), you may receive a digital Certificate of Completion. These certificates are issued by TR Prompting Academy and represent that you have completed the specified coursework. They are not academic degrees, government certifications, or professional licenses unless explicitly stated otherwise.
9. Third-Party Tools and Services
Our courses reference and utilize third-party AI tools and frameworks, including but not limited to Claude (by Anthropic) and Nano Banana. Your use of these third-party tools is subject to their respective terms of service and privacy policies. TR Prompting Academy is not affiliated with, endorsed by, or officially partnered with Anthropic or the developers of Nano Banana unless explicitly stated.
10. Disclaimers
- Our Services are provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not guarantee specific career outcomes, salary increases, or employment as a result of completing our courses.
- While we strive for accuracy, we make no warranties regarding the completeness, reliability, or currentness of course content.
- We are not responsible for technical issues arising from third-party AI tools or platforms used in conjunction with our courses.
11. Limitation of Liability
To the maximum extent permitted by law, TR Public Records, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Services. Our total liability for any claim arising from these Terms or our Services shall not exceed the amount you paid for the specific course giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless TR Public Records, LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorney's fees) arising from your violation of these Terms, your use of the Services, or your infringement of any third-party rights.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or our Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in Austin, Texas. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction.
14. Termination
We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to access course content will cease.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy & Access Terms, constitute the entire agreement between you and TR Public Records, LLC regarding the use of our Services.
